Preamble
The work[at] platform (hereinafter the "Platform") is published and operated by Winford Capital LLC, operating under the trade name Winford Next (hereinafter "work[at]", "we", "our", "us"), a company incorporated under the laws of the State of Wyoming, United States, with its registered office at 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, USA.
work[at] is an online recruitment platform enabling candidates and companies to connect, publish job postings, manage applications, and hire directly.
These Terms of Use (hereinafter the "Terms") govern access to and use of the Platform accessible at workat.pro.
By accessing the Platform or creating an account, you acknowledge that you have read, understood, and unconditionally accepted these Terms. If you do not accept these Terms, please do not use the Platform.
Article 1 - Definitions
For the purposes of these Terms, the following terms shall have the meanings assigned to them below:
- "Platform" - the website workat.pro, its associated mobile applications, programming interfaces (APIs), and all digital services offered by work[at].
- "User" - any natural or legal person accessing the Platform, whether as a Candidate or a Company.
- "Candidate" - any natural person using the Platform to search for employment, submit applications, or create a professional profile.
- "Company" - any legal entity or professional using the Platform to post job openings, search for candidates, or manage recruitment processes.
- "Content" - all data, information, texts, files, CVs, portfolios, job postings, and any other element published or submitted by Users on the Platform.
- "Services" - all features and services offered by work[at], including free and paid plans.
- "Paid Plan" - any subscription or feature subject to billing, processed via Stripe.
Article 2 - Legal Capacity and Minimum Age
The Platform is exclusively reserved for natural persons aged 18 years or older, as well as legally authorized representatives of legal entities.
By creating an account, you declare and warrant that you:
If work[at] discovers that an account has been created by a minor, that account will be immediately suspended and deleted without notice or obligation to retain associated data.
- Are at least 18 years of age;
- Have full legal capacity to accept these Terms;
- If acting on behalf of a legal entity, are duly authorized to bind said entity.
Article 3 - Account Creation and User Responsibilities
3.1 Account Creation - Access to most Platform features requires the creation of an account. Upon registration, you agree to provide accurate, complete, and up-to-date information.
You are solely responsible for the confidentiality of your login credentials. Any activity performed from your account is deemed to have been carried out by you. In the event of loss, theft, or unauthorized use of your credentials, you must notify work[at] immediately at contact@workat.pro.
3.2 Candidate Obligations - Candidates agree to provide accurate and truthful information in their profile, CV, portfolio, and attachments; update their information when changes occur; and use the Platform exclusively for legitimate job searching or professional opportunity purposes.
3.3 Company Obligations - Companies agree to post only lawful, genuine, accurate, and non-discriminatory job openings; ensure their job postings and recruitment practices comply with applicable employment and equal opportunity legislation; not use Candidate data for any purpose other than recruitment; and handle applications received with respect and due diligence.
3.4 Common Obligations - All Users are prohibited from:
- Impersonating any natural or legal person;
- Publishing false, misleading, abusive, defamatory, obscene, unlawful, or discriminatory content;
- Collecting, extracting, copying, or exploiting Platform data by any automated means (scraping, bots, crawlers, etc.) without prior written authorization from work[at];
- Attempting to compromise the security, integrity, or performance of the Platform;
- Using the Platform for any purpose contrary to the law or these Terms.
Article 4 - Non-Discrimination
work[at] is committed to promoting fair and inclusive recruitment. Job postings published on the Platform may not contain discriminatory criteria based on, including but not limited to:
Any job posting containing discriminatory elements will be removed without notice. The account of the Company concerned may be suspended or permanently terminated depending on the severity of the violation.
work[at] complies with applicable International Labour Organization (ILO) conventions on equal treatment in employment, as well as applicable Malagasy legislation, including Law No. 2003-044 of the Labour Code of Madagascar.
- Gender, sex, sexual orientation, or gender identity;
- National, ethnic, or racial origin;
- Religion or beliefs;
- Disability or health condition;
- Age;
- Family situation or pregnancy;
- Any other criterion prohibited by applicable law.
Article 5 - Content and Moderation
5.1 Editorial Responsibility - work[at] acts as a host within the meaning of applicable laws relating to information society services. As such, work[at] is not the author of Content published by Users and does not exercise prior editorial control over such Content. work[at] liability may not be engaged on the basis of Content published by Users, subject to the prompt removal of any unlawful Content upon notification.
5.2 Reporting Procedure - Any User may report unlawful, abusive, or Terms-violating Content by sending a report to contact@workat.pro. The report must include precise identification of the reported Content (link, screenshot), the nature of the issue identified, and the reporter contact details.
work[at] undertakes to review all reports within a reasonable timeframe and to take appropriate measures, which may include Content removal, account suspension, or account termination.
5.3 Sanctions - In the event of a breach of these Terms, work[at] reserves the right to issue a warning, temporarily suspend access to the account, permanently delete the account without notice or compensation, or report the matter to the competent authorities if the breach constitutes a criminal offense.
Article 6 - Services and Features
work[at] offers a range of Services including: job posting, application management, internal messaging, candidate profile tools, matching features, and visibility products such as boosted job postings.
work[at] reserves the right to update, suspend, modify, or remove any or all of its Services at any time, particularly for security, legal compliance, or product improvement reasons. Where possible, Users on a paid plan will be informed of any material changes with reasonable notice.
Article 7 - Paid Plans, Billing, and Refunds
7.1 Payment Processing - Paid plans and premium features are billed in euros (EUR). Payments are processed by Stripe, Inc., a payment services provider headquartered in the United States. Billing operations, renewals, and payment method management are handled through Stripe infrastructure.
Winford Capital LLC (DBA Winford Next) is the contracting entity for all transactions. The billing address that may appear on Stripe statements corresponds to the registered office: 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, USA.
7.2 Subscriptions and Renewal - Unless otherwise indicated, subscriptions renew automatically according to the selected frequency (monthly or annual). The User will be billed at each renewal date according to the subscribed plan. The User may cancel their subscription at any time from their account management area. Upon cancellation, access to the paid plan remains active until the end of the current billing period, without extension or pro-rata refund.
7.3 Refund Policy - As a general rule, payments made are non-refundable once processed. Any exceptional refund remains at work[at] discretion and may be granted in duly justified circumstances, upon request to contact@workat.pro. In the event of a billing error attributable to work[at], the corresponding refund will be issued without delay.
7.4 Billing Disputes - Any dispute relating to a billing transaction must be reported to work[at] within 30 days of the date of the disputed transaction, at contact@workat.pro.
Article 8 - Intellectual Property
8.1 work[at] Property - The Platform, its source code, architecture, graphic elements, visual identity, trademarks, logos, domain names, and all original content produced by work[at] are and remain the exclusive property of Winford Capital LLC (DBA Winford Next) or its licensors. Any reproduction, representation, modification, exploitation, or use of these elements, in any form whatsoever, without prior written authorization from work[at], is strictly prohibited.
8.2 User Content - Users retain full ownership of the Content they publish on the Platform. By publishing Content, the User grants work[at] a limited, non-exclusive, worldwide, revocable, and non-transferable license to use, store, reproduce, and display such Content, solely for the purposes necessary to operate and improve the Services.
work[at] undertakes not to assign, sell, or commercially exploit Users Content for the benefit of third parties. Content associated with an account will be deleted within 90 days following the closure of said account, unless a contrary legal retention obligation applies.
Article 9 - Personal Data Protection
9.1 Data Controller - The data controller for personal data collected via the Platform is Winford Capital LLC (DBA Winford Next), 1309 Coffeen Avenue STE 1200, Sheridan, Wyoming 82801, USA. Contact: contact@workat.pro.
9.2 Data Collected and Purposes - work[at] collects and processes personal data to the extent necessary for the provision of the Services, including identification data (name, email address) for account management, professional data (CV, experience, skills) for recruitment features, billing data transmitted to Stripe for payment processing, and navigation and usage data for Platform improvement and security.
9.3 Hosting and Transfers - Application data is hosted in Western Europe (EU West - Ireland). Certain third-party providers (payment, email, analytics, security) may process data outside the European Union, in compliance with applicable safeguards provided by relevant regulations (standard contractual clauses or equivalent).
9.4 User Rights - In accordance with applicable data protection regulations, in particular the General Data Protection Regulation (GDPR) for residents of the European Union, every User has the following rights: access, rectification, erasure, portability, objection, and restriction. To exercise these rights, contact work[at] at contact@workat.pro. A detailed Privacy Policy, available on the Platform, supplements the provisions of this article.
Article 10 - Availability, Force Majeure, and Limitation of Liability
10.1 Availability - work[at] endeavors to keep the Platform accessible and secure. However, work[at] does not guarantee uninterrupted availability. Planned maintenance operations may result in temporary interruptions, of which Users on a paid plan will be informed where possible with reasonable advance notice.
10.2 Force Majeure - work[at] shall not be held liable for any failure to perform its obligations resulting from a force majeure event, understood as any external, unforeseeable, and irresistible event, including infrastructure or network outages, cyberattacks, natural disasters, epidemics, armed conflicts, terrorist acts, or governmental decisions making the provision of the Services impossible.
10.3 Limitation of Liability - To the fullest extent permitted by applicable law, work[at] shall not be liable for indirect, incidental, or consequential losses; loss of business or professional opportunities; Content published by Users; results achieved (or not achieved) in the context of a recruitment process; or service interruptions due to causes outside work[at] control.
work[at] does not guarantee the obtaining of employment, a hire, or any other specific professional outcome from the use of the Platform.
Article 11 - Governing Law and Jurisdiction
These Terms are governed by the laws of the State of Wyoming, United States, without prejudice to mandatory provisions applicable in the User country of residence.
In the event of a dispute, the parties agree to seek an amicable resolution within 30 days of notification. Failing that, any dispute shall be submitted to the exclusive jurisdiction of the competent courts of the State of Wyoming, unless a mandatory legal provision to the contrary applies in the User country of residence.
For Users residing in the European Union, protective provisions of European consumer law remain applicable notwithstanding the choice of law clause above.
Article 12 - Amendments to the Terms
work[at] reserves the right to amend these Terms at any time. In the event of a material change, Users will be notified by email with a minimum notice of 30 days before the new terms take effect.
If the User does not accept the new terms, they have the right to terminate their account without charge before the effective date. Failure to terminate within this period constitutes tacit acceptance of the new Terms.
The current version of the Terms is always accessible on the Platform.
Article 13 - Termination
13.1 Termination by the User - Any User may close their account at any time from their account settings or by contacting contact@workat.pro. Termination takes effect immediately for free accounts, and at the end of the current billing period for paid accounts.
13.2 Termination by work[at] - work[at] reserves the right to suspend or terminate an account, with or without notice depending on severity, in the event of breach of these Terms, fraudulent or unlawful activity, non-payment of amounts due, or prolonged account inactivity.
In the event of termination for serious breach, no refund will be issued for the remaining period.
Article 14 - Miscellaneous Provisions
Entire Agreement - These Terms, supplemented by work[at] Privacy Policy, constitute the entire agreement between the User and work[at] relating to use of the Platform.
Severability - If any provision of these Terms is declared void or unenforceable, the remaining provisions remain in force and fully applicable.
Non-Waiver - work[at] failure to exercise a right provided for in these Terms shall not constitute a waiver of that right for the future.
Language - These Terms are drafted in English. In the event of translation into another language, the English version shall prevail in the event of any discrepancy.
